D. Schreiber called the meeting to order at 7:30 PM.

L. Kouyoumjian made a motion to seat T. Gutowski and R. Peloquin as alternates.  F. Dirrigl seconded the motion.  All in favor.  Motion carried.

W2008-11 Application for activity related to multi-family development (Winterberry Hill) east side of River Road 1000 ft north of Baxter Road (Map 10 Lot 21) Owner/Applicant Willington River Corp (Received June 9, 2008 ~Public Hearing July 28, 2008. decision within 35 day after close of P.H.)

A letter from Hank Torcellini of Gardner & Peterson Associates was submitted on the modifications incorporated into the new plans.

A discussion was held on to whom to send the new application and plans for review.  It was decided that it should go to the previous reviewers and a hydro-geologist. Staff will determine where to send for review and action was tabled for this meeting.

W2008-6 Applicant to construct driveway , crossing of wetlands & installation of culverts at 14 Balazs Road (Map 44 Lot 17 Zone R80) Owner/Applicant: Craig A. Johnson (Received May 12, 2008 Public Hearing ~or ~Decision by July 14, 2008)

Ed Pelletier of Datum Engineering was present for the applicant.

D. Schreiber commented that he had gone on a site walk earlier in the day.  He said the flagging is not well marked.  He recommended the commission hold a public hearing.  R. Peloquin concurred on that as he felt it deserved a public hearing.  

A discussion was held on the slopes.

R. Peloquin made a motion to hold a public hearing for the reason that the activity may have a significant impact on the surrounding wetlands and the Fenton River. T. Gutowski seconded the motion.

Mr. Pelletier passed out revised plans.  A brief discussion was held on the revisions and the crossing of the wetlands.

 All in favor.  Motion carried.

A vote was held on the motion to set the public hearing for July 14, 2008.  All in favor.  Motion carried.

W2008-7 Applicant for construction of single family dwelling, septic system, drilling well, driveway & site grading within upland review area.18 Balazs Road (Map 44 Lot 16 Zone R80) Owner/Applicant: Craig A. Johnson (Received May 12, 2008 Public Hearing ~or Decision by July 14, 2008)

Mr. Pelletier was present for the applicant.  He presented revised plans and commented that there is no wetland crossing but all activity is in the regulated area.  He said all the proposed activity is on the flat area; no activity is on the steep slopes.  

F. Dirrigl asked if a wetland evaluation had been done.  Mr. Pelletier said the wetlands have been flagged but an evaluation has not been done.

A discussion was held on the site location and the Bissonnette Pond.  

F. Dirrigl made a motion to hold a public hearing because of the sensitivity of the activity on the Fenton Brook.  R. Peloquin seconded the motion.  All in favor.  Motion carried.  A Public Hearing was set for July 14, 2008.

A discussion was held on conducting site walks before the public hearing.  The commission set a site walk for Saturday, June 29, 2008.  Mr. Pelletier said he would meet the commission member at the site.  

W2008-8 Application to re subdivide lot #2 Miscavage ~Subdivision to construct a single family dwelling Activity in upland review area 33 Kollar Road (Map 24 Lot 24 Zone R80) Owner/Applicant: Thomas & Linda Margarido (Received June 9, 2008 Public Hearing or Decision by July 28, 2008)

Mr. Pelletier was present for the applicant.  He presented revised plans based on previous comments from the commission.  The revision was dated 6/23/2008.  

F. Dirrigl submitted a memo regarding his Vernal Pool Site Review.  

A discussion was held on the pond and the wetland review area.  A discussion was held on the zoning regulations.  

F. Dirrigl explained his review of the area.  He said he did not do a full Vernal Pool Study. He said it is questionable whether or not it is a Vernal Pool.  He commented that he did not feel the activity was going to have any adverse effects on the wetlands.  He said he does not see a problem.

T. Gutowski asked about alternatives.  A discussion was held on the alternatives and T. Gutowski asked Mr. Pelletier to submit this in writing.  A discussion was held on the driveway.

F. Dirrigl made a motion to approve application W2008-8. L. Kouyoumjian seconded the motion.  All in favor.  Motion carried.

W2003 -49 Notice of violation: TravelCenters of America (the Lessee) and ~~George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road. Site walk Nov 18, 2007 at 11: 00 A.M.

S. Yorgensen commented that TravelCenters sent a letter to her on the work they were going to do.  A discussion was held on the Notice of Violation.  The commission concluded that they would like to have a maintenance plan from TravelCenters and DEP’s review.

Approval of Minutes

L. Kouyoumjian made a motion to approve the minutes of 5/12/2008.  R. Peloquin seconded the motion.  All in favor.  Motion carried.

R. Peloquin made a motion to approve the minutes of 6/9/2008.  D. Schreiber seconded the motion.  F. Dirrigl and T. Gutowski abstained.  All others in favor.  Motion carried.

Staff Report

Discussion was held on a piece of property that was being used as a camping area.  S. Yorgensen commented that it was really a zoning issue but that G. Jones would send a letter of violation to the parties involved if required.

Discussion

Discussion was held on property on Clint Eldredge Rd and a trench which was dug into the wetlands.  T. Gutowski commented that she is concerned about her lower property.  She said her wetlands are being degraded.

Discussion was held on the sand on the road and the way in which it is being handled by Public Works.

L. Kouyoumjian made a motion to adjourn at 8:45.  All in favor.
